Edtomorrow Terms of Service

These Terms of Service (“Terms”) apply to all digital platforms and services operated by Edtomorrow LLC, including The First Five, The First Five Plus, and related educator resources (collectively, the “Services”). By accessing or using any of our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Services.


1. Overview

Edtomorrow provides educators with free and premium resources designed to support connection, care, and character in classrooms. Our Services include:

  • A free daily email resource (“The First Five”)
  • A subscription-based platform (“The First Five Plus”) offering expanded access, searchable content, and additional features

2. Use of Services

Our Services are intended for educational use. You may access and use the content for personal, classroom, and non-commercial purposes only.

You may not:

  • Reproduce, redistribute, or resell content
  • Use content for commercial purposes without written permission
  • Share paid account access with others

3. Content Ownership

All content provided through Edtomorrow, including The First Five and First Five Plus, remains the property of Edtomorrow LLC or its licensors.

You are granted a limited, non-exclusive, non-transferable license to use the content solely for educational purposes in accordance with these Terms.


4. Subscription and Billing

The First Five (Free)

The First Five is a free daily email resource. You may subscribe or unsubscribe at any time.

First Five Plus (Paid Subscription)

First Five Plus includes free trials and paid subscription options.

By subscribing, you agree that:

  • You will be charged according to the plan selected (monthly, yearly, or other options presented at checkout)
  • Subscriptions may automatically renew unless canceled before the renewal date
  • Pricing and features may change over time, but any changes will be clearly communicated

You are responsible for managing your subscription and billing details.


5. Free Trials and Promotions

We may offer free trials, promotional access, or redemption codes.

  • Free trials convert to paid subscriptions unless canceled before the trial ends
  • Redemption codes must be used within the terms provided
  • We reserve the right to modify or revoke promotional offers at any time

6. Account Registration (First Five Plus)

To access First Five Plus, you must create an account using a valid email address.

You agree to:

  • Keep your login credentials secure
  • Not share your account with others
  • Be responsible for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms.


7. Age Restriction

Our Services are intended for users 18 years or older. By using our Services, you confirm that you meet this requirement.


8. Privacy and Data Collection

Your use of our Services is governed by our Privacy Policy. By using our Services, you consent to the collection and use of your information as described in that policy.


9. Service Availability and Changes

We are continuously improving our Services. As a result:

  • Features, content, and access levels may change over time
  • Certain content may move between free and paid tiers
  • We do not guarantee uninterrupted or error-free service

We will make reasonable efforts to communicate significant changes.


10. Termination

We may suspend or terminate your access to the Services at any time for:

Upon termination, your access to paid features will end immediately.


11. Limitation of Liability

To the fullest extent permitted by law, Edtomorrow and its affiliates are not liable for any indirect, incidental, or consequential damages resulting from your use of the Services.

Our total liability will not exceed:

  • The amount you paid in the six (6) months prior to the claim, or
  • $100 USD, whichever is greater

12. Arbitration and Dispute Resolution

Any disputes arising from these Terms or your use of the Services will be resolved through binding arbitration, except where prohibited by law.

You may:

  • Bring claims in small claims court if eligible
  • Seek injunctive relief for intellectual property violations

Before initiating arbitration, you must provide written notice and allow 30 days for informal resolution.


13. Governing Law

These Terms are governed by the laws of the State of Texas, United States.


14. Modifications

We may update these Terms from time to time. Updates will be reflected by the Effective Date. Continued use of the Services indicates acceptance of the updated Terms.
